Welcome to Galway Cakes

These Terms of Service explain the terms and conditions that apply when you visit our website, place an order, purchase our baked goods, or interact with our business online.

By using our website or placing an order, you agree to these Terms of Service.

1. About Us

Business name: Galway Cakes
Location: Galway, Ireland
Email: galwaycakes1@gmail.com

2. Our Products

We sell freshly prepared baked goods, including cookies, brownies, and other bakery products listed on our website.

Product images are for illustration purposes only. As our products are handmade, there may be slight variations in size, appearance, colour, toppings, decoration, and packaging.

We make every effort to describe our products accurately, including flavours, allergens, ingredients, and storage guidance where applicable.

3. Ordering From Us

When you place an order through our website, you are responsible for ensuring that all order details are correct before completing payment.

This includes:

  • Product selection
  • Quantity
  • Delivery address
  • Eircode
  • Phone number
  • Email address
  • Delivery date, where applicable
  • Allergy or special instruction information

Once your order is placed, you should receive an order confirmation by email. This confirms that we have received your order, but we reserve the right to refuse or cancel an order where necessary, for example due to product availability, payment issues, suspected fraud, incorrect pricing, or delivery limitations.

4. Prices and Payment

All prices are shown in euro (€).

Prices may change from time to time, but this will not affect orders that have already been confirmed.

Payment must be made at the time of ordering through the payment methods available on our website.

We use third-party payment providers, such as [Shopify Payments / Stripe / PayPal / Revolut / other provider], to process payments securely. We do not store your full card details.

5. Delivery and Shipping

We ship orders across Ireland using third-party delivery or courier services.

Delivery times are estimates only and may be affected by courier delays, weather, public holidays, incorrect address details, or other circumstances outside our control.

We are not responsible for delays or failed deliveries caused by:

  • Incorrect or incomplete delivery addresses
  • Missing Eircodes
  • No one being available to receive the order
  • Courier delays outside our control
  • Failure to collect a parcel from a courier collection point
  • Events outside our reasonable control

Please ensure your delivery details are accurate before placing your order.

6. Freshness and Storage

Our baked goods are freshly prepared and packaged with care.

Once delivered, it is the customer’s responsibility to store the products correctly and consume them within the recommended timeframe.

Storage guidance may be provided on the product packaging, website, or order information.

We are not responsible for product quality issues caused by incorrect storage, delayed collection, exposure to heat, or failure to follow storage instructions after delivery.

7. Allergens and Dietary Information

Our products are made in a kitchen that handles common allergens, including but not limited to:

gluten, wheat, eggs, milk, soya, nuts, peanuts, and sulphites.

While we take care when preparing and packaging orders, we cannot guarantee that any product is completely free from traces of allergens.

Customers with allergies, intolerances, or dietary requirements are responsible for checking product information before ordering. If you have a serious allergy, please contact us before placing an order.

By placing an order, you acknowledge that our products may contain or come into contact with allergens.

8. Cancellations

Because our products are freshly baked and perishable, cancellations are only accepted before an order has been baked, prepared, packed, or dispatched.

Once an order has been prepared or shipped, we are unable to cancel it or offer a refund for change of mind.

Irish and EU online shopping rules usually provide a 14-day cooling-off period, but this right has exceptions, including goods that are perishable or unsuitable for return for health or hygiene reasons.

9. Returns and Refunds

Due to the perishable nature of our baked goods, we do not accept returns once an order has been dispatched or delivered.

For food safety and hygiene reasons, edible products cannot be returned, resold, or exchanged after they have left our kitchen.

However, this does not affect your statutory rights. If your order arrives faulty, damaged, incorrect, or not as described, please contact us within 24 hours of delivery with:

  • Your order number
  • Clear photos of the product
  • Clear photos of the packaging
  • A short description of the issue

Where appropriate, we may offer a replacement, refund, partial refund, or store credit.

Irish consumer law gives consumers rights where goods are faulty or not as described, including refund rights in certain circumstances.

10. Personalised or Custom Orders

If we offer personalised, custom, or special request products, these may not be eligible for cancellation once work has started.

This includes orders made to your specific requirements, such as custom messages, custom flavours, special quantities, event orders, or personalised packaging.

11. Website Information

We aim to keep our website accurate and up to date, but we cannot guarantee that all information will always be free from errors.

We reserve the right to correct errors, update product information, change prices, update delivery details, or remove products from sale at any time.

If there is an obvious pricing or product error, we may cancel the order and refund you.

15. Privacy and Personal Data

We collect and use personal information in line with our Privacy Policy.

This may include your name, contact details, delivery address, order information, and payment confirmation details.

Please read our Privacy Policy for more information on how we collect, use, store, and protect your personal data.

If your website uses cookies or tracking technologies, customer consent may be required for certain cookies under Irish data protection guidance.

16. Limitation of Liability

We are not responsible for losses caused by circumstances outside our reasonable control, including courier delays, incorrect delivery information, weather disruption, strikes, technical issues, or events beyond our control.

Nothing in these Terms limits your statutory consumer rights or excludes liability where it would be unlawful to do so.

17. Changes to These Terms

We may update these Terms of Service from time to time.

The latest version will always be available on our website. By continuing to use our website or placing an order after changes are made, you agree to the updated terms.
